The Legal / Regulatory Consultant, Tanwa Koya commenced a five month input under the Atkins-ITAD-Enplan WSSSRP TA Contract short-term national budget on the 12th August 2009.
The ToR required a review of the state water supply services sector with a view to developing instruments to enhance and improve the formal legal, regulatory, institutional and commercial framework and enshrining certainty, sustainability and accountability in service delivery in the six partner states (Anambra, Osun, Cross River, Kano, Jigawa and Yobe) covered by WSSSRP.
The ToR also stated that the work should feed upon the reviews and studies already undertaken at both national and state level and should create a chronological progression from policy development to policy implementation by the development of action plans for the water sector in each partner state as well as developing appropriate instruments for adoption. These instruments should include a water policy for states with no policy, a health and safety policy for the water sector, a plan for implementation including strategic planning, legislative review and a new law, PPP considerations and institutional framework.
This report provides a progress report on the activities of the Legal/ Regulatory Consultant based on the TOR, the current status of the focal states water sectors in terms of reform and governance as well as the legislative framework. A full set of meeting notes and returns on questionnaires for each state are held by the consultant for review by interested parties.
Finally the report provides recommendations on an implementation programme for the next phase of work to be undertaken in 2010.
